New Delhi: The Supreme Court of India has stayed the bail granted to former BJP MLA Kuldeep Singh Sengar in the Unnao rape case. The order stops his release for now. The apex court has issued a notice to Sengar and asked him to respond. The court will hear the matter again after four weeks.
The ruling marks an important step in a case that triggered nationwide anger. Many see the case as a test of India’s criminal justice system. It also highlights concerns around sexual violence and political power.
Supreme Court Hears Plea on Sentence Suspension
On Monday, the Supreme Court heard arguments on Sengar’s request to suspend his life sentence. A bench led by Chief Justice of India Surya Kant heard the matter. The bench also included two other judges. Both sides presented their arguments.
The Solicitor General opposed the plea. He called the Unnao rape case horrific. He said the court framed charges under Section 376 of the IPC and the POCSO Act.
He added that the law prescribes strict punishment for such crimes. The minimum sentence stands at 20 years in jail. Courts can extend it to life imprisonment.
Court Raises Questions on Minimum Punishment
During the hearing, the Chief Justice said the court would stay the Delhi High Court’s bail order for now. He also asked whether the minimum sentence applies if the victim is not a minor.
The Solicitor General replied that recent legal changes apply the 20-year minimum sentence. He said the law treats such crimes with utmost seriousness.
CBI Challenges Delhi High Court Order on Unnao Rape Case
On December 23, the Delhi High Court suspended Sengar’s sentence and granted him bail. The court imposed a condition. Sengar must stay at least five kilometres away from the victim.
The Central Bureau of Investigation challenged this order soon after. The agency told the Supreme Court that bail in such cases sets a dangerous example. It also harms victim safety and justice.
Protests Erupt in Support of Survivor
Protests broke out following the bail order. Women Congress workers held demonstrations in support of the survivor. Police detained several protestors after clashes.
Activists also criticised the High Court ruling. Many expressed hope that the Supreme Court would reverse the decision.
Background of the Unnao Rape Case
Kuldeep Singh Sengar served as a BJP legislator from Uttar Pradesh’s Unnao district. A court convicted him in one of India’s most controversial rape cases. The case drew attention due to claims of political pressure and threats to the survivor.
The court later sentenced Sengar to life imprisonment. Many viewed the verdict as a strong stand against political influence.
What Happens Next
The Supreme Court has paused the bail and sought Sengar’s reply. The next hearing will take place in four weeks. The court will then decide whether Sengar remains in jail or gets bail again.
Legal experts and activists have welcomed the Supreme Court’s move. They say courts must act firmly in serious crimes. They also stress that abuse of power should not weaken justice.
